SIA “Kinuvel” operates the online store and website kinuvel.com and sells products in accordance with these Terms of Service.

1. General terms and scope

These Terms of Service govern purchases made through kinuvel.com and the use of the online store and its related services.

If you are a natural person purchasing products primarily for purposes unrelated to your trade, business, craft or profession, you are considered a consumer for the purposes of applicable consumer protection law.

Purchases made by consumers through kinuvel.com are distance contracts and are subject to applicable consumer protection laws.

By placing an order, you confirm that you have had the opportunity to review these Terms of Service and the information provided to you before completing the purchase.

2. Products and product information

The main characteristics, descriptions, prices and other relevant information about products are displayed on the relevant product pages.

We aim to ensure that product information is accurate and up to date. Minor differences in product appearance, packaging or colour may occur, including due to changes made by the manufacturer, screen settings or photography, provided that such differences do not affect the product’s conformity with the contract.

Product images are provided for illustrative purposes and should be considered together with the written product description.

3. Price

Product prices are displayed on kinuvel.com in the currency shown for the relevant market or during checkout.

Where required by applicable law, displayed consumer prices include applicable value added tax.

Before you place an order, the total amount payable, including applicable taxes and delivery charges, will be displayed during checkout.

Any additional charges that apply to the order and are known to us will be disclosed before the order is submitted.

4. Placing an order and conclusion of the contract

To place an order, you select the desired products, add them to your cart, provide the required information, select an available delivery and payment method and submit the order.

You are responsible for ensuring that the information provided during checkout is accurate and complete.

Before submitting the order, you have the opportunity to review the products selected, quantities, delivery information and total price.

After the order is submitted and payment has been successfully completed or confirmed, we will send an order confirmation to the email address provided during checkout.

Unless otherwise expressly stated during checkout, the sales contract between you and Kinuvel is concluded when the order has been successfully submitted, payment has been received or confirmed and we send you the order confirmation.

Please retain the order confirmation for your records.

If we are unable to fulfil an order after the contract has been concluded due to an objective reason, such as the product becoming unavailable, we will inform you without undue delay and refund any amount paid for the product that cannot be supplied.

5. Payment

The available payment methods and applicable currency are displayed during checkout before you place the order.

Depending on availability, payment methods may include:

online banking;

payment cards;

Apple Pay or Google Pay;

other payment methods displayed during checkout.

Payments may be processed by third-party payment service providers.

Information necessary to process and verify the payment may be transmitted to the relevant payment service provider.

6. Delivery

We deliver products to the countries and locations available for selection during checkout.

Available delivery methods, delivery charges and estimated delivery times are displayed before the order is confirmed or described in our Shipping Policy.

Orders are usually prepared for dispatch within 1 to 3 business days.

Estimated delivery times depend on the destination and delivery method. Delivery estimates are not guarantees unless a specific delivery date has been expressly agreed.

Unless another delivery period has been agreed with you, products will be delivered without undue delay and no later than 30 calendar days after the sales contract is concluded, where this period applies under applicable consumer protection law.

Where delivery is arranged by Kinuvel using a delivery provider offered by us, the risk of loss of or damage to the product generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the product.

7. Customs duties and import charges

Orders shipped within the customs territory of the European Union are generally not subject to import customs duties solely because products are transported from one EU Member State to another.

Orders delivered to countries or territories outside the customs territory of the European Union may be subject to import duties, taxes, customs clearance fees or other charges imposed in the destination country.

Unless expressly stated otherwise during checkout, such charges are the responsibility of the customer.

8. Right of withdrawal

If you are a consumer, you generally have the right to withdraw from a distance purchase without giving a reason within 14 calendar days, subject to the exceptions provided by applicable law.

For purchases of goods, the withdrawal period generally begins on the day on which you, or a third party designated by you other than the carrier, physically receive the product.

You may exercise your right of withdrawal by clearly informing us at: info@kinuvel.com

You may also exercise your right of withdrawal using the electronic withdrawal function available on kinuvel.com.

If you submit a withdrawal through the electronic withdrawal function, we will confirm receipt of the withdrawal on a durable medium, such as by email, without undue delay.

After notifying us of your withdrawal, you must return the relevant product without undue delay and no later than 14 calendar days from the date on which you informed us of your decision to withdraw.

The statutory consumer right of withdrawal does not apply to legal entities or to natural persons purchasing primarily for purposes related to their trade, business, craft or profession.

9. Cosmetics and hygiene-related exceptions

The statutory right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons where the relevant seal has been removed or broken after delivery.

This exception may apply to cosmetic products where a hygienic seal, protective film, safety seal or other protective closure intended to preserve the hygiene and safety of the product has been opened or broken after delivery and the product is no longer suitable for return for health protection or hygiene reasons.

This exception does not affect your statutory rights if a product is defective, damaged during delivery or does not conform to the contract.

Where the right of withdrawal applies, you may inspect and handle a product only to the extent necessary to establish its nature, characteristics and functioning. You may be responsible for any reduction in value resulting from handling beyond what is necessary for that purpose.

10. Refunds and return costs

Where you validly exercise your right of withdrawal, refunds will be processed in accordance with applicable consumer protection law and our Refund Policy.

Where required by applicable law, we will reimburse the payments received for the products covered by the withdrawal and the original delivery costs up to the amount of the least expensive standard delivery method offered by us.

Additional delivery costs resulting from your choice of a more expensive delivery method do not have to be reimbursed.

Unless we have agreed otherwise, the consumer is responsible for the direct cost of returning products when exercising the statutory right of withdrawal for a product that is not defective.

Refunds are generally made using the same payment method used for the original transaction unless otherwise expressly agreed.

11. Defective, damaged or non-conforming products

Kinuvel is responsible for ensuring that products supplied to consumers conform to the sales contract in accordance with applicable consumer protection law.

If a product is defective, damaged during delivery, incorrect or otherwise does not conform to the contract, please contact us at info@kinuvel.com.

Please include your order number, a description of the issue and, where reasonably possible, photographs that help show the problem.

Photographs may help us assess the issue more quickly but are not, by themselves, a condition for exercising statutory consumer rights.

Consumers have the statutory remedies provided by applicable law for products that do not conform to the contract.

Depending on the circumstances and applicable law, these remedies may include bringing the product into conformity, replacement, an appropriate reduction in price or termination of the contract and reimbursement.

Under applicable Latvian consumer law, the seller is responsible for a lack of conformity existing at the time of delivery that becomes apparent within two years from delivery. Consumers in other countries may benefit from equivalent or additional mandatory rights under the law applicable to them.

Nothing in these Terms limits any mandatory statutory rights relating to defective or non-conforming products.

12. Consumer complaints

If you believe that your rights relating to a purchase have been infringed, you may submit a written complaint to: info@kinuvel.com

Please provide sufficient information to identify the order, describe the issue and explain the remedy you are requesting.

Where Latvian consumer law applies, we will provide a written response to a consumer’s written complaint within 15 business days from the date on which it is received, unless an agreement has already been reached or an objectively justified extension is permitted by applicable law.

Where another mandatory response period applies under the law protecting you as a consumer, we will comply with that period.

13. Use of cosmetic products

Cosmetic products sold through kinuvel.com must be used in accordance with their intended purpose and the information provided on the product label, packaging or instructions for use.

Before using a product, please review the ingredient list, instructions and any warnings provided with the product.

If irritation or another unwanted reaction occurs, discontinue use where appropriate.

Individual experiences and cosmetic results may vary depending on individual characteristics, the way the product is used, consistency of use and other factors.

Nothing in this section limits your statutory rights in relation to a defective or non-conforming product.

14. Product availability and errors

Product availability may change from time to time.

We aim to keep information about availability, prices and product descriptions accurate. However, technical, administrative or human errors may occasionally occur.

Before a sales contract is concluded, we may refuse an order where there is a legitimate reason to do so, including where a product is unavailable, payment cannot be authorized, delivery to the requested destination is unavailable or there are reasonable grounds to suspect fraud or misuse.

If an error or circumstance affecting an order is discovered after a contract has been concluded, we will deal with the situation in accordance with applicable law.

If an order or part of an order cannot lawfully be fulfilled and payment has already been made, the relevant amount will be refunded without undue delay.

Changes to product prices, promotions or availability do not affect already concluded sales contracts except where permitted by applicable law or expressly agreed with the customer.

15. Promotions and discount codes

From time to time, Kinuvel may offer promotional prices, discount codes or other special offers.

Specific promotions may be subject to additional conditions communicated together with the relevant offer.

Unless otherwise stated:

discount codes have no cash value;

only one discount code may be applied per order where the checkout does not allow multiple codes;

discount codes must be used within any stated validity period;

promotions may be limited to particular products, markets or customers.

Promotional conditions do not limit mandatory consumer rights.

16. Personal data and marketing communications

We process personal data in accordance with our Privacy Policy and applicable data protection law.

If you have provided the required consent to receive marketing communications, we may send you information about Kinuvel products, news, offers and promotions.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the email or by contacting us at info@kinuvel.com.

17. Website content and intellectual property

Unless otherwise stated, the content made available through kinuvel.com, including text, product descriptions, branding, graphics, photographs, designs and other website materials, is owned by or licensed to Kinuvel and is protected by applicable intellectual property laws.

You may access and use the website for personal and lawful purposes.

You may not reproduce, distribute, modify, commercially exploit or otherwise use protected website content without the permission of the relevant rights holder, except where such use is permitted by applicable law.

Nothing in these Terms transfers any intellectual property rights to you.

18. Acceptable use of the website

You must not knowingly use kinuvel.com in a way that:

violates applicable law;

infringes the rights of another person;

attempts to gain unauthorized access to the website, systems or customer information;

introduces malicious code or otherwise interferes with the security or operation of the website;

uses automated systems to abuse, disrupt or materially overload the Services;

is fraudulent or intended to misuse promotions, payments or ordering functionality.

We may take reasonable measures to protect the website, customers and our systems from unlawful, fraudulent or abusive activity.

19. Liability and circumstances beyond reasonable control

Kinuvel is responsible for its obligations to consumers to the extent required by applicable law.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

We are not responsible for losses caused solely by circumstances for which we are not legally responsible.

If performance is delayed or prevented by exceptional circumstances beyond our reasonable control, we will take reasonable steps to minimize the effect of the disruption and fulfil our obligations as soon as reasonably possible.

A delay, error or failure by a delivery provider or another service provider chosen by Kinuvel does not by itself remove any responsibility that applicable consumer law places on Kinuvel as the seller.

20. Governing law

These Terms of Service and sales contracts concluded through kinuvel.com are governed by the laws of the Republic of Latvia, to the extent permitted by applicable European Union and national law.

If you are a consumer, this choice of law does not deprive you of the protection provided by mandatory provisions of the law that would apply to you in the absence of this choice.

In particular, where Kinuvel directs its commercial activities to the country in which a consumer has their habitual residence, the consumer retains the protection of mandatory consumer law applicable under European Union conflict-of-law rules.

21. Dispute resolution

If a dispute arises between you and Kinuvel, we encourage you to contact us first so that we can attempt to resolve the matter directly.

If a consumer dispute cannot be resolved directly, the consumer may have the right to seek assistance from a competent consumer protection authority or an applicable alternative dispute resolution body.

As Kinuvel is established in Latvia, eligible consumer disputes may be referred to the Latvian consumer protection system, including the Consumer Rights Protection Centre and, where applicable, the Consumer Dispute Resolution Commission.

For cross-border disputes within the European Union, consumers may also seek assistance from the European Consumer Centres Network (ECC-Net).

Nothing in these Terms limits a consumer’s right to bring a claim before a competent court.

Where European Union rules on jurisdiction for consumer contracts apply, a consumer may have the right to bring proceedings in the courts provided for under those rules, including, in applicable circumstances, the courts of the Member State in which the consumer is domiciled.

22. Changes to these Terms

We may update these Terms of Service from time to time, for example where our Services, payment or delivery methods, business practices or legal requirements change.

The current version of the Terms of Service will be available on kinuvel.com.

Changes apply from the time the updated Terms are published unless otherwise stated.

Changes do not retroactively alter a sales contract that was already concluded under an earlier version of these Terms unless this is required by law or validly agreed with the customer.
